  • Our members will be entitled to a free telephonic on online consultation with our online attorney for legal advice and assistance.The member will have the option to continue with the referred attorneys services but will be liable for the fee agreed upon by the client and the attorney.

Do you want to get rid of your Criminal Record?

Since May 2009, the criminal procedure act made provision for persons with a minor criminal record to apply at their record(s) may be expunged.

Expungement is the process by which a criminal record is cleared and removed from your personal record and gives you the opportunity to start with a new beginning and clean record in life!

Don’t let a criminal record prevent you from rights that you’re entitled to such as a new job, immigration/emigration, an application for a fire-arm licence, your integrity and GOOD NAME.

In short it will mean that after a successful application your criminal record (will not appear) on any clearance certificate.

You will qualify to remove your criminal record if:

  • 10 years have lapsed after the date of the conviction of your latest offence, AND;
  • You did not receive a direct prison sentence for your conviction and a fine that has exceed R20 000 , AND;
  • You have not been convicted and imprisoned for any other offence during those 10 years, without the option of a fine;
  • You were sentenced to a relatively minor charge.

If you fulfil with the requirements as stated above, you can apply directly at the Department of Justice for the expungement of your criminal record(s).

After your application has been granted, the criminal record centre is directed to physically remove your criminal record(s) from their system and it will not appear on your clearance certificate.

The process to remove your record is a lengthy process and takes about three months to complete.

Unfortunately due to the fact that you are dealing with to state departments to remove your record it may be a lengthy and frustrating process and will your attorney be in a position to assist you with the process.
